Top 3 Tips for Residential Construction Liens in Texas

If you’re a residential general contractor in Texas, here’s our top 3 tips to make sure you have a valid mechanics lien against homestead:

(1) Get your contract in writing. Every. Time.

Verbal contracts won’t get you a lien against homestead.

(2) ALL owners must sign the contract.

Every homeowner (or intended homeowner) must sign. Working for a married couple? They both must sign for themselves. Get both signatures, every time. Do this before you start any work.

(3) Record your contract

Record your contract in the county where you performed the work. (If you forgot to do this, we can do it for you when we file your lien).

And . . .

(4) Include the Required Special Homeowner Notice

When it’s time to file your mechanics lien, you must include a special homeowner notice required by the Texas Property Code.
